How is it Panera's fault to have known that Sarah Katz, the victim, had a heart condition. Being 21, an adult, she is well above age to be responsible for her own actions. She had practiced avoiding energy drinks per doctor recommendation. Doctor Berul should be at fault for stating, " it’s fine to have a Coke or a small coffee each day," The bottom line is that no caffeine should be consumed. It is a legalized drug just waiting for the next heart attack victim. "Beloved, I wish above all things that thou mayest prosper and be in health, even as thy soul prospereth" (3 John 1:2).
